Copyright Law Recently, I read a well written article on Copyright Law. What I found most interesting is that the author condemns all author's whatever their art form as thieves. The author wants every citation of every source to be quoted and listed. That means if I over hear your conversation I must list you in my Bibliographic Citation. If I get an idea from a billboard, I have to list it in my Bibliographic Citation. If I pick up a newspaper and read an article that gives me the date of a famous person who died and I print this in my blog, I have to list it in my Bibliographic Citation. If we accept the author's premise then all art would be reduced to a list in my Bibliographic Citations. What if I have a dream about something I read or saw. Do I list it in my Bibliographic Citation? The paradigm of what constitutes copyright law is shifting. In Convergence Culture: Fan Fiction By Henry Jenkins, Mr Jenkins has identified an issue: the economic my copyright right comes up against the creative my creative speech right. I sure this will play out over the next century. Yes, it will take that long. And what will be the end results. Freedom of speech takes precedence over copyright. If the copyright right wins then we had better all go home and die. Without the ability of a creative person to blend and change what has gone before then there is no creative freedom. Without creative freedom then all have to get in lock step. Would you want your child told you can't draw that because you saw it on a DVD? Does that mean an artist has to give a residual to the zoo where they drew and painted an animal? Do you give it to the zoo or to the animal? Ridiculous, you say. No, fair is fair. All information and all human creations must be free for the user to decide. We all like recognition. Even the author of the article on copyright law wants recognition. They created it. That should be enough. That should be enough. Most Artist never get recognized and still they continue to produce their creative art. Everyone takes from others. Did you not take and use the inspiration of your parents? Did you not take and use the encouragement of your teachers and professors? If you tell a store, recite a joke or just think about something someone told you no matter how long ago it was then according to the author of the article on Copyright Law your a thief. So it's off to jail you go, do not pass go and do not collect $200.00. Ops. I guess I'm off to jail with you. Really, this is not a joke and will get serious in the near future.
